7 Steps to Write a Non-Exclusive Agreement

Step 1: Specify the Parties

There are generally two parties involved in such an agreement. The first stage of preparing a non-exclusive agreement form is to define the sides or parties involved in the contract. If any other company is also a part of this agreement, such a case along with the details of the third party or parties should be mentioned.

Step 2: Mention Important Details

The next thing to do while making the agreement is to mention the title. Then provide the date of drafting the agreement. The names of both the parties should be written in bold at the top of the page. Then you need to provide the addresses, proper contact information and other required personal details.

Step 3: Provide the No Exclusivity Clause

The non-exclusivity clause is the most important provision of the agreement. Providing or including a no exclusivity clause in the agreement would allow full liberty to your associate to make comparable agreements with other companies. On the other hand, the clause would also prevent the restriction of involvement of the associates in other accessible advantages.

Step 4: Provide an Intellectual Property Clause

In this section, you need to provide the duration of the agreement. This will determine the length of the validity of your agreement. Your agreement can be a short term arrangement for over two years or more, or it can be a long term arrangement where the contract will be terminated only when one party wishes so.

Step 7: Provide the Signatures and Date

At the end of the agreement, provide spaces for putting the signature and date of both parties. This step is very important as without it there is no way to prove that both parties acknowledge and comply with the agreement.
